Welcome to Kisschat.ai. These Terms of Service govern your access to and use of our platform. By creating an account or using our services, you agree to be bound by these terms. Please read them carefully.

1. Eligibility & Age Requirement

  • Minimum Age: You must be at least 18 years of age (or the age of majority in your jurisdiction) to use Kisschat.ai. If you are under 18, you are strictly prohibited from accessing the Service.
  • Verification: We reserve the right to verify your age through third-party services or by requesting government-issued identification.
  • Consent: By using the Service, you represent and warrant that you fulfill these age requirements.
  • Jurisdiction: If the use of this service is illegal in your location, you must not access it.
  • Responsibility: You are responsible for ensuring your use of the service complies with local laws.

2. User Accounts

  • Registration: To access certain features, you must create an account. You agree to provide accurate, complete, and updated information.
  • Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
  • Accuracy: You agree to provide accurate and current information. Impersonating others or providing false data is grounds for termination.
  • Security: You must not share your password or let anyone else access your account.
  • Suspicious Activity: Report any unauthorized access immediately.

3. User-Generated Content & Conduct

  • Our platform allows you to interact with AI characters and create custom content.
  • Ownership: You retain rights to the original content you create, but you grant Kisschat.ai a non-exclusive, royalty-free license to host, store, and display that content for the purpose of operating the Service.
  • Prohibited Content: You may not use the Service to generate or share content that is illegal, promotes real-world violence, involves non-consensual imagery, or violates the intellectual property of others.
  • AI Interactions: You acknowledge that interactions are with Artificial Intelligence. While we strive for high-quality outputs, Kisschat.ai is not responsible for the specific responses generated by AI models.
  • Community Standards: All conduct must comply with our Community Guidelines.

4. Restrictions on Use

  • You will not use the Service for any purpose other than features we intentionally make available.
  • You will not copy, download, or distribute any part of the Service without prior written authorization.

  • You will not use web crawlers, bots, or automated indexers in connection with the Service.
  • You will not post unlawful, threatening, abusive, harassing, defamatory, or discriminatory content.
  • You will not upload material that infringes copyright, patent, trademark, or other intellectual property rights.
  • You will not stalk, bully, or harass any person or entity.
  • You will not harm minors in any way. Child Safety is a zero-tolerance policy.

5. Payments & Subscriptions

BillingAll payments are processed through secure third-party gateways. We do not store full card details.
RefundsDue to the digital nature of the Service, all purchases are generally non-refundable. See our Refund Policy for details.
CancellationsYou may cancel your subscription at any time through your account settings to avoid future charges.
CreditsVirtual credits (KissCoins) do not roll over between billing cycles. See Subscription Terms for full details.
UpgradesUpgrading takes effect immediately; remaining credits from previous plan are forfeited.

6. Intellectual Property

  • The Kisschat.ai name, logo, software, and proprietary AI configurations are the property of Kisschat.ai and are protected by copyright and trademark laws.
  • You may not copy, modify, or reverse-engineer any part of the platform without express written permission.
  • For personal use, you may view, copy, and print pages from the Service.
  • You may not build a business using the Content, whether or not for profit.
  • All AI-generated content is produced by computer algorithms and is subject to our intellectual property terms.

7. DMCA & Copyright

  • If you believe any content on the Service infringes your copyright, please contact our Copyright Compliance Department at support@kisschat.ai.
  • Your DMCA notice must include: a physical or electronic signature, identification of the copyrighted work, identification of the infringing material, your contact information, a good faith belief statement, and a statement of accuracy under penalty of perjury.

8. Warranties & Disclaimers

  • You warrant that the information you provide is true, accurate, and not misleading.
  • You warrant that you will use the Service lawfully and in good faith.
  • You warrant that you have permission of any individuals depicted in content you submit.
  • KISSCHAT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9. Indemnity

You agree to indemnify, defend, and hold harmless Kisschat.ai and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, losses, damages, costs, and expenses (including attorney's fees) arising from: (1) your use of or access to the Service; (2) your breach of these Terms; (3) your violation of any third-party right; (4) any claim that your content caused damage; or (5) any transaction you conduct via the Service.

10. Limitation of Liability

  • To the maximum extent permitted by law, Kisschat.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • In no event shall our total aggregate liability exceed the amount paid by you to us in the last six months.

11. Termination

  • We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice.
  • Grounds for termination include: violation of these Terms, harmful conduct toward other users, or actions against our business interests.
  • Upon termination, your right to use the Service ceases immediately.
  • Provisions that by their nature should survive termination will remain in effect.

12. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of Ghana.
  • Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Accra, Ghana.
  • You agree that the Service shall be deemed solely based in Ghana.
  • Class Action Waiver: ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION.

13. General Provisions

  • Assignment: These Terms may be assigned by Kisschat without restriction. You may not assign your rights without Kisschat's prior written consent.
  • Entire Agreement: These Terms constitute the entire agreement between you and Kisschat regarding the Service.
  • Severability: If any provision is found invalid, the remaining provisions remain in full force.
  • No Waiver: Failure to enforce any right does not constitute a waiver of that right.
  • Privacy Policy: Our Privacy Policy is incorporated into these Terms by reference.
